As many have said. Seek legal advice asap from a good family law specialist.

Courts now see that a child needs the presence of a father in their upbringing and as such have changed the system quite a bit, they will be legally required to go to mediation initially, to see if an agreement of custody can be reached.

Then if that fails, it goes before a judge in court. But again, tell him not to delay in seeking out a good lawyer specialising in family law.
