If he doesn't front up to court, you will usually automatically win the case and get a court order for him to return the money. He is given a certain amount of time to pay. If he still doesn't, you can get access to a bailiff to seize property at his home address.
It doesnt cost as much as you think for a court date. $27 I think for a hearing. and around $160 for bailiff services. Both of which you can claim off him on top of the money for the phone.

Sounds like too much hassle if you ask me - most people tend to be forthcoming after about the 3rd consecutive yellow-sticker (placed on an angle) on their pride and joy (or so I've heard anyway). But seriously dude, I hope you get your money back or at the very least get your moneys worth in seeing him learn his lesson the hard way.
