I really can't understand the foglight ruling that seems to be rigidly enforced when most other states allow them, and we're encouraged to turn on lights for safety. As long as they don't dazzle oncoming cars (factory fogs are usually well diffused) I can't see any reason why they dont encourage their use. Every day I see countless cyclists without helmets getting away with it, yet the moment you turn the fogs on you get nailed like a criminal. I use mine late at night when I arrive home so I can turn the headlights off and see the driveway and not wake up my neighbours. |

The argument is based on customer ignorance in the case of fog lamps. There is currently NO awareness raising campaigns to my knowledge on laws surrounding driving with fog lamps on and never has there been an effort, yet if you get caught you are fined a larger sum of money than going slightly over the speed limit. Under these present penal conditions then, it seems more 'logical' to do slightly over the speed limit than be caught with your fog lamps on in terms of punishment. We forget that most laws that we as a democratic society agree to uphold are made for the safety and protection of self and others. Speeding laws and related penalties make sense under this practice (eg- the punishment/ deterant fits the potential crime)... I don't think you will logically find that fog lamps fit this category?? Yet this law is still upheld quite blindly as to why it was ever invented in the first place! This has been demonstrated over and over again by stories of officers enforcing this law giving little to no understanding or reason as to why they are doing it other than that it is 'the law', not to mention the indescrepency of demerits/ fine amounts enforced despite Giddyup highlighting this here!! But each to their own opinion. If you can prove to me how foglamps are AS potentially dangerous as speeding for example, particularly when most lamps use lower wattage then headlights and as others have pointed out here are lower to the ground, having little effect to oncoming traffic sight... then your argument will be the more logical won't it?

When I had my 06 impreza I was pulled over on 3 seperate occasions for having fog lamps on, and on all 3 occasions I was let off with a warning
I was always told you can only have them on during heavy rain or fog. So yes they are iilegal to have on. And annoying on 4WDs. |

The cars in the pics probably get away with this as the lights being position lights not lamps. Position globes be they led or globes are legal to burn all the time and with lamps. |

Another farked up law of little relevance to the real world and no justification to the level of penalty [when compared to speeding fines] as subarooboy mentions above IMO

I think the foglight law is stupid also, not arguing with you there. However, if car manufacturers are required to have this 'duty of care' then all cars would be speed limited to 110km/h and oh yeah, no foglights. Again it is the WA govt. that makes and enforces these laws, so the onus is on the govt. Plus laws change all the time, so a car bought in 1996 may have different laws to 2006 for example. Do you expect car makers to send every single car owner bulletins of updates of law changes? No , but I expect the govt. to do that. Giddyup, still waiting on your official verdict on whether LED DRLs are legal or not

LOL only reason i learnt about this fog light law was about a week after having the car was exiting freo on a sat'd night after going to a movie with a mate, foglights on, south terrace exit, female cop comes up to me stopped at the lights and asks me if i'd like to give her $150.. when i looked at her quizzically, she's like, turn ya fog lights off -.o Was nice to see a cop with a sense of humour for a change.

On the subject of DRL's, well they have to be legal. Simply coz they have been included on cars from factory for an awful long time (Volvos since the 70's) and all cars have to comply with ADR's; so by deduction, they are legal.... or put another way, they are not illegal.
