As for your fitout issues, do you have a make good agreement in the contract? If so, the builder has to "make good" on the fitout before they can be paid in full. Many won't do this though, as things do arise in the current environment (especially with the demand on tradespeople at the current time) and they can agree to fix problems in due course, after the construction is completed, rather than do it before releasing the fitout to the tenant. They CAN be c*nts about it though if its not explicitly outlined in the contract. If you're not having much luck, get your lessor's FM manager onto them....they'd be as keen to get the fitout completed as you are, and they'd probably have a lot more pull with the builder too. Unfortunately due to the current market I flew a team of guys from Melbourne and trucked the shop over (cheaper than WA companies) so they dont do a lot of local stuff. As it is a franchise and they do most of the new franchises (have done around 120) you would hope they have an interest to finish the job but are dragging their heals to say the least. Funniest part is there accounts people keep ringing for final payment - dreaming a lot of stuff isnt per the plans and this is where most the issues lie

Yeah im building at the moment and so are in laws and before u make last payment they are meant to go through with you and check. For any issues, They cant leave it. Its part of contract too that they fix or supply house as requested on plans

I assume you have signed a standard HIA Lump Sum Building Contract?
If so you are obligued to make payment within 10 working days of the home being "Practically Complete", the builder is also obligued to rectify all items on the Practical Completion Inspection sheet (you did sign one eh?). Practical Completion has generally been interpreted by the legal fraternity to mean fit for occupation without major siruption or inconvience to the occupier. All this crap about trade shortages is BS, the construction market has flattened out and there is not a problem with trades like there were 8-9 months ago. As for the plans showing the Solar Pamels on the western side, the builder will argue that the home is built to the plans which you have signed, this is not likely to hold up at a Building Dispute Tribunal Hearing, unless there is a very clear reason for doing this, as the builder is holding themselves out to be expert in design/construction. I work in the project building industry and have for 10+ years, I am not a legal expert but have gotten involved in more than the odd dispute.
