If his name is on the title, then he has every right to be there. I doubt a court could even order you out, unless she doesnt something stupid like a restraining order.

In either case, its a pretty shit situation to be in. But i agree, if she wants out, then she should get out. I dont mean to get sexist, and im pretty sure you said she doesnt have a job, so i wonder who's money paid for the house, her luxuries and the raising of his kids?

Tell him to get to a lawyer who specializes in family law straight away. I know a couple of good ones if he needs one.

Tell him to not procrastinate on it, go straight to a respectable lawyer, pay for some 'decent' advice and take steps from there. It's a war and emotions won't help, use the system - nice guys finish last.

Had to slip a funny in there, but honestly seek the family court lawyer, don't give in to her, dont argue in front of the kids, move into the garage if you need to.

And investigate the wife cheating thing...seems interesting she just decided that she doesn't love him anymore. If she is then you'll be holding the upper hand in everything.

Makes no difference whatsoever...

Get initial advice from a lawyer, but if at all possible get agreement between parties rather than have 2 law firms go at it.
Who lives in or leaves the house also makes no difference on the final outcome re the split of property.

I can garuantee that about 6-8 months after the divorce is over she will contact him and try to be 'friends' again.....The grass always seems greener until she gets there and realises the comfortable lifestyle she had is gone and she becomes some haggard looking single mum no-one wants to date.
